Welcome to Pockets by Hoopy. These Terms of Service ("Terms") are the agreement between you and Pockets by Hoopy ("we," "us," "the app") for your use of the app and website. Please read them — especially the sections on financial guidance, disclaimers, and liability. By creating an account or using the app, you agree to these Terms. If you don't agree, please don't use the app.

1. Who we are and how to reach us

Pockets by Hoopy is a personal-budgeting app built around a "pockets" (envelope) method and a single Good to Go (safe to spend) number. Questions about these Terms? Email support@byhoopy.com.

2. Pockets by Hoopy is a tool, not financial advice

Pockets by Hoopy is an informational budgeting tool only. It is not financial, investment, tax, accounting, or legal advice, and we are not your financial advisor, broker, or fiduciary. The Good to Go number, forecasts, funding suggestions, category guesses, and every other figure in the app are estimates generated from the data available to us. They can be wrong, delayed, or incomplete.

You are solely responsible for your own financial decisions. Always verify important numbers — such as your actual account balances and upcoming obligations — directly with your bank before you act on them. Do not rely on the app as your only source of truth for spending, bill payment, overdraft avoidance, or any other financial decision.

3. Bank connections and third-party data

Connecting a bank account is optional, but the app is not functional without a bank connection. If you connect one, account and transaction data is provided by third-party aggregation providers (currently Teller and Plaid). That data:

may be delayed, incomplete, or inaccurate, including pending transactions that later change or disappear;
depends on your bank and the provider remaining available — outages, disconnections, or changes on their side can interrupt syncing;
is governed by the provider's own terms and privacy practices in addition to ours.

We are not responsible for the accuracy, timeliness, or availability of data supplied by banks or aggregation providers, or for any decision you make based on it. We never receive or store your online-banking password; see our Privacy Policy for how connection data is handled.

4. Eligibility, accounts, and family use

Pockets by Hoopy is intended for users aged 13 and older, and it is not directed to children under 13. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that happens under your account. Tell us promptly at support@byhoopy.com if you suspect unauthorized use.

Family use. We recognize that budgeting is a valuable skill to learn early. A parent or legal guardian may create and supervise an account on behalf of a minor in their household. By doing so, the parent or guardian agrees to these Terms on the minor's behalf, consents to our collection and use of that account's information as described in our Privacy Policy, and is responsible for the minor's use of the app. We do not knowingly allow children under 13 to create their own accounts without this parental involvement.

5. Acceptable use

You agree not to:

use the app for any unlawful, fraudulent, or abusive purpose;
access data that isn't yours, or attempt to breach or probe our security or another user's account;
scrape, reverse-engineer, decompile, or attempt to extract source code, except where that restriction is prohibited by law;
overload, disrupt, or interfere with the app or its infrastructure, or use automated means to access it in a way that harms the service;
resell, sublicense, or commercially exploit the app without our written permission.

6. Your data and content

You own the information you put into the app (your pockets, budgets, notes, and connected financial data). You grant us a limited license to store, process, and display that information for the sole purpose of operating and improving the service for you, including the automated transaction categorization described in our Privacy Policy. We do not sell your personal information.

7. Fees and plans

Pockets by Hoopy is currently free to use during its pre-production and beta period. We may introduce paid plans or premium features in the future. If we do, we will show the price and terms before you are charged, and we will never silently bill you — any paid plan will require your clear, affirmative opt-in. These Terms will be updated to cover payment details at that time.

8. Beta / pre-production service

The app is under active development and is offered on a pre-production basis. Features may change, break, or be removed; data may occasionally be affected by bugs; and the service may be unavailable at times. We may modify, suspend, or discontinue any part of the app at any time without liability to you.

9. Intellectual property

The app, including its name, logo, design, and software, is owned by Pockets by Hoopy and protected by intellectual-property laws. These Terms grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own budgeting — nothing more.

10. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY BALANCE, FORECAST, OR OTHER FIGURE IT DISPLAYS IS ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKETS BY HOOPY AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF FUNDS, PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP — INCLUDING ANY FINANCIAL DECISION MADE IN RELIANCE ON IT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE LIABILITY CANNOT BE FULLY EXCLUDED, IT IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $50.

12. Indemnification

You agree to indemnify and hold harmless Pockets by Hoopy and its operator from any claims, losses, or expenses (including reasonable legal fees) arising out of your misuse of the app or your violation of these Terms or of any law or third-party right.

13. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the app in a way that risks harm to you, other users, or the service. Sections that by their nature should survive termination (such as disclaimers, limitation of liability, and intellectual property) will continue to apply.

14. Changes to these Terms

We may update these Terms as the app evolves. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use after an update means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws of the State of Vermont, USA, without regard to its conflict-of-laws rules. You agree that any dispute will be handled in the state or federal courts located in Vermont, unless applicable law gives you the right to bring it elsewhere.
